What do I need to bring to my first meeting with the lawyer?


Often, people who are looking into filing for bankruptcy want to file immediately to:

  1. Save their homes.

  2. Prevent the depletion of savings and retirement accounts.

  3. Prevent utilities from being cut off.

  4. Stop or prevent a lawsuit against them.

  5. Prevent Repossession.

  6. Prevent or stop garnishments.

  7. Regain a sense of control in their lives and in their finances


Do I need to file for Chapter 7 or Chapter 13 protection?  Do I get to keep my property?  Can I stop garnishment, foreclosure, repossession, or a lawsuit?  Will Creditors stop calling me?


Because it's often essential to get bankruptcy protection and debt relief quickly, it's important to manage the process effectively from the start. The first step? Meet with a bankruptcy lawyer.


To make this step more efficient, its helps to come to your meeting prepared. We suggest that you bring as many of the following documents to your meeting as possible:

  1. Your latest credit card statements, whether or not you owe anything at the time.

  2. You latest home loan/mortgage statements.

  3. Payroll stubs for last six months for each person involved in the potential bankruptcy action.

  4. Tax returns and personal property bills for the last four years.

  5. Copies of your monthly bills. This can include loan information, car/truck payments, dry cleaning bills, grocery bills, church donations, medical expense, day care bills, entertainment receipts, alimony and child support expenses, and all other monthly bills and expenses.


Why do we need these things?

  1. Bankruptcy Court requires this information.  The sooner we get the Court the information, the sooner we get you on the way from the debt burden you feel now to the relief you will feel once you have completed your bankruptcy filing.

  2. We sometimes find information in your bills and see expenses that you can reduce or even do away with completely. If we can spot enough of these, you might not have to go through bankruptcy at all.

  3. It's always important to tell your lawyer too much information rather than not enough. You lawyer needs to know it all - good, bad, embarrassing, proud, shameful, triumphant. We may be able to pull something together for you that you never imagined.
