Chapter 13 Bankruptcy

Chapter 13 of the United States Bankruptcy Code provides protection and financial relief for people with incomes who can afford to pay at least some of their creditors back, or who can afford to pay all of their creditors back at least in part.  Over three to five years, the bankruptcy court collects an amount from the debtor's paycheck and divides the money among creditors. The court effectively becomes a "middleman" for paying these debts.


Chapter 13 bankruptcy, sometimes called "wage earners” bankruptcy, usually requires that filers have a job and a certain level of disposable income.  Through disposable income, filers restructure debt obligations and pay it off - often at reduced rates.  Unlike plans offered by "debt consolidation companies," Chapter 13 gives filers the power to legally reduce debt payments, consolidate payments and wrap up what was once almost impossible to payoff debt in just 36 to 60 months (three to five years).
