          Threats to repossess property, foreclose on your home, garnish your paycheck or shut off your utilities, cable TV or cell phone, even when the debt has nothing to do with these services. They threaten, but they cannot accomplish these things. They may claim to have connections, but if they were to actually do any of these things, they as well as the people who help them would find themselves charged as criminals - and they know it. Their threats are illegal.



          Threats of physical harm to clients and their families. Again, these are the types of things loan sharks threaten. These threats are completely illegal. 



If anyone threatens you with something you know to be illegal, call your attorney immediately, call the Arkansas Attorney General, and call the Arkansas Better Business Bureau in your area. Behavior such as we describe above is not legal anywhere and is not to be tolerated from anyone.


When you declare bankruptcy, creditors are almost immediately barred from contacting you in most circumstances. Instead, they must go through your lawyer. In Chapter 7 bankruptcy, all exempt property is protected. In Chapter 13 bankruptcy, all property is protected.


Don't believe creditors when the claim they're on your side and "want to help you". Don't believe creditors when they say that if you use your last dollars to pay a portion of debt, they won't bother you.

When you have no money to pay them, calls from creditors are intimidating.

At worst, creditors may actually use illegal tactics to collect from debtors like you.


We stop the debt collector from doing things like:

          Visit neighbors of the debtor. If a creditor has actually sent someone to the door of a neighbor looking for a person who owed them money in an attempt to collect the debt, the creditor is behaving like a loan shark. Such behavior goes beyond intimidation. It is threatening, and it is illegal.



          Calls to the debtor's workplace. You feel humiliated because these people are calling you at work, demanding money from you. Your co-workers question what is going on. Eventually your boss catches on. The atmosphere created by these calls does not increase your pay, enabling you to pay the debt. It serves only to embarrass you in front of your co-workers. Your work quality and productivity may actually suffer to the point where your employer must fire you. If a creditor interferes with your job, it is interfering with your ability to pay the debt. Obviously, if you lose your job because of insistent creditor calls, it does neither you nor the creditor any good. The creditor's behavior is malicious, and illegal.



          Threats of jail or of criminal prosecution. Debtor's prison was abolished in Europe centuries ago, and has never existed in the United States. In fact, the Bankruptcy Code was established in this
